The international community has faced situations in which civilian aircraft have crashed due to missile strikes or the like.However, the disputes in important incidents such as the Libyan Lockerbie plane, the Korean 007 and the Iranian Airbus have not been resolved through legal means, and the parties to the dispute have tried to pay and receive reparation by agreement without identifying responsibility.This type of payment is called ‘ex gratia'.The question of the present research is how to evaluate the status of ‘ex gratia’in international law in the context of the incurring the situations in the international community (the Libyan Lockerbie plane,the Korean 007and the Iranian Airbus)?The following article, using a descriptive-analytical method, has shown that the proposition of ‘ex gratia’is different from the proposition of ‘compensation’ as it is defined in the law of international responsibility. The wrongdoer acts in order to escape the secondary obligation and the injured state acts in order to easily access compensation and sometimes for their own political considerations. Therefore, ILC should consider this issue in discussing the contents of responsibility in the ARSIWA (2001). Moreover, such an action can lead to a more systematic application of the rules of the law of international responsibility.
